1. Acceptance of Terms

By accessing or using the Insert MD website or the PepPal application (collectively, the "Services"), you agree to these Terms & Conditions. If you do not agree, do not use the Services.

2. Nature of the Services

Insert MD is a service and technology platform that helps wellness businesses offer physician-directed peptide and wellness programs. Insert MD does not practice medicine, provide medical advice, or dispense medication. All clinical evaluations and prescriptions are performed by independent, licensed providers, and all medications are compounded and dispensed by independently licensed pharmacies. These providers and pharmacies are not employees or agents of Insert MD.

3. No Medical Advice; No Provider-Patient Relationship

Content on the Services is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Using the Services does not create a provider-patient relationship with Insert MD. Always seek the advice of a qualified healthcare professional. In an emergency, call 911.

4. Compounded Medications

Compounded medications are prepared based on a specific patient need and are not approved by the U.S. Food and Drug Administration (FDA). The FDA does not review compounded medications for safety, effectiveness, or quality. A valid prescription is required, and medication is provided only after evaluation by a licensed provider who determines it is medically appropriate. Products and services are offered only where legally permitted.

5. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. Business users represent that they are authorized to act on behalf of their organization.

Wellness businesses using the platform are responsible for complying with all laws applicable to their operations, including licensing, advertising, and consumer protection requirements, and for using only approved marketing materials and claims.

8. Intellectual Property

The Services, including the Insert MD and PepPal names, logos, software, and content, are owned by Insert MD or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated.

9. Third-Party Services

The Services may link to or integrate with third parties (such as independent providers, pharmacies, and payment processors). We are not responsible for the content, products, or practices of third parties.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant any specific clinical or financial outcome.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSERT MD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless Insert MD from claims arising out of your use of the Services or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
